Bryan Cave Attorneys Address Employee Monitoring

New York Partner Zachary Hummel and Associate Joseph Sanscrainte will address the sometimes delicate topic of employee monitoring and the value it may bring at an upcoming roundtable event.

The Jan. 14 discussion will outline the numerous types of employee surveillance, including Internet and e-mail usage monitoring, personal information collection, employee screening, telephone monitoring and physical searches. They also will address ways for companies to minimize monitoring costs in the current economic crisis.

A member of the firm’s Labor & Employment Client Service Group, Hummel has had primary responsibility for the preparation and presentation of numerous arbitrations on a wide range of issues ranging from employee discipline and discharge to employer policies and procedures, including such topics as drug testing policy, production scheduling, absentee programs, return to work agreements following strikes, workforce reduction, drug abuse and management rights. In addition, he has experience in handling defense and prosecution of unfair labor practice charges before the NLRB and has represented employers in OSHA investigations and Department of Labor investigations pursuant to the FLSA. In federal court, he has represented employers in discrimination lawsuits, Section 301 damage actions, actions for breach of contract or breach of duty of fair representation and wrongful discharge cases.

Sanscrainte is a member of the Regulatory Affairs, Public Policy & Legislation and Antitrust/U.S. Trade Regulation Client Service Groups. He practices in the areas of teleservices law, consumer protection and privacy. Sanscrainte is the former general counsel and director of regulatory affairs for Call Compliance Inc., a developer of compliance solutions for the teleservices sector. He is a frequent speaker on teleservices and privacy compliance issues, a frequent contributor to the DMNews and often is quoted by publications regarding the teleservices industry.
